States challenge federal funding restrictions on trans youth care

Federal

New York's attorney general announced September 2 that 21 state attorneys general, including the District of Columbia, and Pennsylvania's governor sued HHS and CMS over federal funding restrictions on gender-affirming care. The coalition challenges Medicaid reimbursement exclusions for treatment of gender dysphoria in patients under 18 and similar CHIP restrictions for those under 19. It argues that CMS exceeded its authority and asks the federal court in Massachusetts to block enforcement. This is a separate lawsuit from the New Hampshire families' case. The filing is a challenge to restrictions that threaten low-income trans young people's care; it does not itself suspend the rule or establish a court victory.
