South African Equality Court orders remedies for anti-LGBTQIA hate speech

South Africa

South Africa's Human Rights Commission reported October 12 that the Gqeberha Equality Court found Dawood Lagardien responsible for hate speech, unfair discrimination and harassment. The case concerned a shop sign excluding LGBTQIA+ people and harmful messages in a WhatsApp group. The court ordered a public apology, R200,000 in damages to an equality-promoting NGO and an injunction against further unlawful conduct. It referred the matter for criminal investigation, which is not a criminal conviction. This applies existing equality protections to a specific case; it does not establish nationwide safety improvements or a transgender-specific outcome. Effective remedies matter for communities targeted in public and online spaces.
