Oklahoma Supreme Court interprets birth-certificate law to bar sex-marker changes

Oklahoma

In Fowler v. Stitt, decided September 29, the Oklahoma Supreme Court answered questions from the Tenth Circuit by holding that state law bars changes to the sex designation on Oklahoma birth certificates, including changes based on gender identity.

The opinion interprets state statutes; it does not resolve the remaining federal equal-protection litigation. It reinforces an existing barrier to accurate identity documents for trans Oklahomans. The published text warns that the opinion has not been released for publication and remains subject to revision or withdrawal. Existing serious state-profile warnings remain warranted.
