Madrid court confirms reinstatement for trans worker fired during transition
The Madrid regional high court upheld a ruling that a company unlawfully dismissed a trans woman during her gender transition, Cinco Días reported on September 22. The court confirmed her reinstatement and €20,000 in compensation for moral harm.
The lower court ruled in late 2025. The new development is the regional court’s confirmation. According to the report, the judges considered the timing of the dismissal, a short medical leave, and the employer’s scrutiny of her work. The outcome applies to this worker; the report does not establish a new nationwide statute.
The decision shows that workplace discrimination protections can provide a remedy. It does not erase the risk of discrimination, nor does one individual appeal establish a durable change to Spain’s eight national score dimensions. Employment and legal scores remain unchanged pending broader evidence.
