Allahabad High Court excludes trans woman from Section 69 protection in bail order

India

In an October 15 bail order, the Allahabad High Court interpreted Section 69 of India's criminal code to exclude a trans woman from its protection against sex obtained through deceit or a false marriage promise. It granted bail to the accused while trial remains pending. This exclusion denies equal protection in this case; the court confined its interpretation to Section 69 and cited the separate sexual-abuse provision in the 2019 Transgender Persons Act. The order does not decide guilt or remove every legal protection for trans people.
